Below are the terms regarding Your Content and Twym Content.

You retain ownership of the content you submit to The Platform (“Your Content”). By submitting Your Content, you grant Twym a worldwide, perpetual, non-exclusive, royalty-free, sublicensable, and transferable license to use, display, distribute, modify, and create derivative works of Your Content in connection with The Platform and its promotion.

Twym owns all content created and made available in connection with The Platform, including (without limitation) visual interfaces, interactive features, graphics, design, compilation, code, products, software, and all other elements. You may not use Twym Content except as expressly authorized by us.

Some features require an account. Keep your details accurate and secure.

To access certain features of The Platform, you may need to create an account. You agree to provide accurate and complete information and to update it as necessary.

You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized use.

You agree to use The Platform only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment. Prohibited behavior includes:

• Harassing or causing distress or inconvenience to any user.
• Transmitting obscene or offensive content.
• Disrupting the normal flow of dialogue within The Platform.

The Platform may host third-party content or link to other websites or applications (“Third-Party Services”). We do not control or endorse Third-Party Content/Services. Your use and reliance are at your own risk.

Twym and its licensees may publicly display advertisements, paid content, and other information near or in association with Your Content. You are not entitled to any compensation. The manner, mode, and extent of such advertising may change without specific notice.

You agree to indemnify, defend, and hold harmless Twym, its parents, subsidiaries, affiliates, and their respective officers, directors, employees, agents, contractors, and representatives from any and all third-party claims, actions, demands, losses, damages, costs, liabilities, and expenses (including reasonable attorneys’ fees and court costs) arising out of or relating to:

• Your access to or use of The Platform, including Your Content;
• Your violation of these Terms; and
• Your breach of your representations and warranties under these Terms.

To the fullest extent permitted by law, Twym’s liability for any claim arising out of these Terms is limited to the amount paid by you to Twym in the 12 months preceding the event giving rise to the claim.

Disputes are handled via binding arbitration as outlined below.

Any dispute arising out of or relating to these Terms or your use of The Platform will be settled through binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration will be held:

• in Ontario, Canada, for Canadian users; or
• in Delaware, USA, for all other users.

• Ontario, Canada, for Canada-based users; or
• Delaware, USA, for all other users.

Twym may modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of The Platform after such changes constitutes acceptance of the new Terms.
